Talisman Group secures legal victory against Light & Wonder subsidiary

Bailey Kennedy law firm Partner Joshua Gilmore and Associate Tayler Bingham were able to secure a key legal victory for the Talisman Group, creators of EZ Baccarat, over Light & Wonder subsidiary LNW Gaming.
Partial summary judgement was entered in Talisman’s favor upon its claim that LNW breached its distribution agreement for the no-commission EZ Baccarat game by marketing British Columbia Lottery Corporation (BCLC)’s Ruyi Baccarat to casinos while still under contract with Talisman.
Judge Joanna Kishner of the Eighth Judicial District Court in Clark County, Nevada, determined that LNW did breach the agreement “by marketing Ruyi Baccarat (a competing product) and taking ‘preorders’ from casinos to lease Ruyi Baccarat … while LNW was still under contract with Talisman.”
“Talisman is a two-person gaming company going up against one of the largest gaming companies in the world,” Gilmore said.
“We are extremely pleased that the court has ruled in our client’s favor on this important issue.”
BCLC announced a new deal with Light & Wonder on August 17, 2023, granting Light & Wonder exclusive licensing rights to Ruyi Baccarat’s intellectual property for North American casino distribution.

Judge Kishner found that LNW “began marketing Ruyi Baccarat to casinos on August 4, 2023,” despite the Strategic Alliance Agreement between Talisman and LNW not expiring until September 8, 2023.
The case is still currently ongoing, as the parties recently traveled to Vancouver, British Columbia, Canada, where they began retaining Canadian counsel to assist in deposing BCLC officials.
EZ Baccarat is now being offered to casinos in North America by Galaxy Gaming.
