Evolution to pursue arbitration in Light & Wonder patent case

Evolution has been officially granted arbitration by the District Court of Nevada, with the supplier set to settle its ongoing patent infringement legal allegation against Light & Wonder out of court.
Following Light & Wonder’s alleged infringement of the terms of agreement set out by Evolution as part of their ongoing partnership agreement, the pair are now set to settle their legal dispute out of court.
The dispute is centred around Light & Wonder’s alleged unauthorized use of Evolution trade secrets to develop a land-based casino game that closely resembled features of a previous online casino game developed and patented by Evolution. Indeed, while the supplier had granted Light & Wonder specific terms that allowed the operator use of some mechanics for its own land-based game development, the specific mathematics of Evolution’s Lightning Roulette title.
After attempting to terminate this licensing agreement, Light & Wonder went on to launch an infringing competitor product called Roulette X – prompting Evolution to take legal action. As such, the District Court of Nevada has now granted Evolution arbitration for the misappropriation of trade secrets.
Good to know: The pair are now required to attend a status conference on October 30 to provide an update on settlement proceedings
Even though this matter is now to be settled out of court, the District of Nevada will retain certain rights now underlined as part of this latest court document.
Specifically, should the court ‘conclude it has authority to determine arbitrability, the court should find that Evolution’s trade secret claims fall under the parties’ arbitration agreement; and (3) alternatively, if the court concludes that it has jurisdiction over the trade secret claims, it should find that the claims are time-barred under the parties’ bargain for one-year limitations period.’
Elsewhere, in Q3, Evolution reported a $607.4m revenue for the second quarter of 2025, up 3.1% year-over-year.
