AGU sends Meta notice to remove illegal iGaming and betting advertising

The Attorney General’s Office (AGU) in Brazil has issued an extrajudicial notice to Meta, asking that the Facebook and Instagram parent company remove its illegal online betting and gaming profile advertising pertaining to the region.
According to the notice, the AGU has requested Meta remove the illegal advertising within 48 hours. The office has also asked that Meta “refrain from re-boosting content that does not comply with the list of companies authorized to carry out the activity of online betting and gaming by the Ministry of Finance and regulatory bodies.”
The AGU cited Brazilian legislation, including Law No. 14,970/2023 and Ordinance SPA/MF No. 1,207/2024 in its call to cease this advertising and said, “Companies that have not obtained authorization from the Ministry of Finance are acting illegally, which also makes advertising their services and applications illegal.”
“It is, therefore, a manifestly illegal activity (since these are profiles not authorized by the Ministry of Finance) – which may also be connected to tax evasion, money laundering, crimes against the consumer relationship, fraud and other illegal practices – configuring its advertising in an equally illicit activity,” the AGU wrote in its notice to Meta.
The office also noted that authorized websites within the region must have the bet.br ULR.
