SPGA members adjust approach in New York

The Social and Promotional Games Association (SPGA) has decided to adjust its New York approach regarding sweepstakes games after some recent constructive conversations with state officials.
The association has determined each member will decide “the most appropriate path forward based on individual legal guidance and strategic priorities.”
“This reflects a broader industry commitment to collaboration and regulatory clarity around sweepstakes-based promotional games,” the SPGA said in a statement.
A spokesperson for SPGA further commented, “Innovation in digital entertainment often requires a constructive and informed dialogue with lawmakers and policymakers. We saw that dynamic with fantasy sports, and we believe the same approach will help shape smart policy around sweepstakes promotions.”
“We know New York officials recognize the need to get this right because any decisions about social sweepstakes could have broader implications — not only for promotions by companies like Starbucks and Marriott, but also for any mobile game where consumers spend money, from Candy Crush and Coin Master to Clash of Clans and Monopoly Go.”
The SPGA cited Senate Bill 5935 as “a clear signal that these games are legal” in the Empire State. The group went on to add that any proposal to ban sweepstakes games “would be unnecessary if they were already prohibited under state law.”
Eilers & Krejcik Gaming (EKG) recently conducted research in the state of Michigan. According to its findings, “social sweepstakes sites do not compete with or negatively impact traditional real-money online casinos” within the Great Lakes State’s online gaming market.
The SPGA said this data supports its claim that sweepstakes games “serve a distinct audience who play these games for distinct reasons.”
The group remains committed to open dialogue with regulators and continues to advocate for players around the country who play these types of games.
