New Hampshire: Supreme Court temporarily reverses decision to revoke Sanborn’s gaming license

The New Hampshire Supreme Court has temporarily reversed a decision to revoke Andy Sanborn’s charitable gaming license to operate Concord Casino, according to a local report from the Concord Monitor.
However, the suspension of his license remains in effect.
Sanborn had filed an appeal against the ruling to revoke his license after the state’s regulator investigated how he had used pandemic relief funds. His attorneys claimed in the appeal that taking Sanborn’s license was an attempt to delay the sale of the casino and confuse potential buyers.
During 2023, the New Hampshire Lottery Commission and the state’s Attorney General launched an inquiry into Sanborn’s use of the pandemic relief funds between the months of January and August 2023.
The investigation found that Sanborn “fraudulently obtained $844,00 in Covid relief funds, which casinos are ineligible to receive, to support his lavish lifestyle.”
According to the investigation, Sanborn had used the money to buy luxury cars for both his wife and for himself by making cash payments that were disguised as rent.
Following the inquiry, the Lottery Commission issued a notice of administrative action against Concord Casino to revoke its charitable gaming license.
In response, Sanborn issued an email statement, claiming that he is “innocent of all wrongdoing.”
Traditional land-based casinos are currently illegal in New Hampshire. However, the state allows its venues to offer players table-based and machine-based games that are connected to local charities.
The current law on the books allows charities statewide to partner with charitable gaming operators, if they do not exceed ten gaming dates per year.
