Brazil: City of Marília launches municipal lottery

The city of Marília, in São Paulo state, has approved a law establishing its own municipal lottery, joining over 70 Brazilian municipalities pursuing similar initiatives to boost public revenue.
Signed by Mayor Vinicius Camarinha, the legislation allows the lottery to be operated directly by the municipality or through private concessions via public tender.
The law authorizes Marília to offer lottery and betting products already permitted under federal legislation, including fixed-odds sports betting regulated nationwide under Law 14.790/2023.
The city will be able to replicate popular lottery-style games but is barred from operating any instant-win or casino-style games banned under the national law.
Camarinha mentioned Supreme Court Justice Nunes Marques’s prior opinion recognizing that municipalities and states may jointly regulate lotteries, provided they follow federal guidelines.
However, the Supreme Court has yet to issue a final ruling, as a constitutional challenge remains pending.

Despite the legal uncertainty, cities like Marília are moving forward in anticipation of a favourable outcome.
Local officials estimate the lottery could generate between BR1m and BR5m annually, funding health, education, security and social projects.
The service may be granted under a concession of up to 25 years, with oversight managed by the city’s Finance and Technology departments to ensure transparency and compliance.
