Brazil: Tocantins court upholds state lottery’s right to operate betting terminals

The Tocantins Court of Justice (TJTO) has upheld the authorisation granted to the state lottery, Lototins, to continue operating sports betting and video lottery terminals (VLTs).
The decision confirms an injunction issued in July, following the suspension of Lototins’ services by a lower court earlier this year.
The local Public Treasury Court had suspended the concession after a popular action alleged irregularities in the selection process and questioned the 20-year contract duration.
However, TJTO’s full bench has now ratified the injunction, allowing operations to proceed.
According to Lototins, the devices used are certified instant VLTs that operate under existing legislation.
The company argued that its concession followed due process and that states are legally authorised to operate lottery-related activities.
The ruling also confirmed that the 20-year concession was valid under current regulations.

Lototins’ contract, signed in March 2025, was awarded through a public tender to a consortium of six companies with the highest bid of BR15.3m.
Under the agreement, revenue generated by the lottery will be distributed to social programmes, including 10% for sports initiatives, 10% for cancer treatment and prevention, 5% for technology investment, 5% for a local NGO and 70% to other state-regulated projects.
