Federal Court grants preliminary approval of $45m settlement related to MGM Resorts data breaches
This relates to data breaches which took place in July 2019 and September 2023.

MGM Resorts International is set to pay a $45m settlement as part of class action taken against the operator over data breaches that took place in July 2019 and September 2023.
These data breaches have been said to have affected “tens of millions” of MGM hotel guests and customers, with personal information stolen, such as addresses, driver’s license numbers, dates of birth, etc, with some of this then put up for sale within online forums.
The main reason for the class action being taken against MGM Resorts was that the plaintiffs alleged the operator had failed to implement the proper protocols in place related to data security.
The preliminary approval of the $45m global settlement by the United States District Court for the District of Nevada includes $75 for Tier 1 Settlement Class members (social security number of military identification number exposed, $50 for Tier 2 Settlement Class Members (passport number or driver’s license exposed), and $20 for Tier 3 Settlement Class Members.
On top of this, all settlement class members can submit a claim for Financial Account Monitoring related to identity theft protection and credit monitoring.

Also, within the settlement it mentions that all settlement class members can submit a Claim Form for a Documented Loss Cash payment for up to $15,000 per settlement class member.
Cohen Milstein Partner Douglas J. McNamara said, “On behalf of millions of MGM Resort customers, I’m very pleased with this settlement.
“The hotel and entertainment industries are particularly desirable targets for hackers. The same hackers also attacked Caesars Entertainment, Inc. in 2023.”
