Churchill Downs avoids lawsuit relating to Kentucky Derby wager

Suit is in relation to the outcome of the 2021 Kentucky Derby.
Churchill Downs will not face a lawsuit in relation to the winner of the 2021 version of the Kentucky Derby, according to Bloomberg Law.
The winner of the 2021 Kentucky Derby was thoroughbred racehorse Medina Spirit. However, nine months later, the Kentucky Horse Racing Commission’s stewards disqualified the horse because of a failed post-race drug test.
This led to redistributed prize money to horse owners based on a new order of finish for the race, but a ruling stated that “pari-mutuel wagering is not affected by this ruling.”
A group of bettors filed a proposed class action based on the fact that their bets would be winning wagers if the new order of finish counted for wagering purposes.
Nonetheless, under Kentucky law, only the first order of finishing that is marked “official” counts when it comes to wagering purposes.
Within the case, it says, “But, under Kentucky law governing pari-mutuel wagering, the first official order of finish is final. Under that order, the plaintiffs lost their bets. For this reason, the complaint fails to state a claim upon which relief can be granted. Further, as the plaintiffs’ proposed amendment does not cure this flaw, the district court properly denied leave to amend.”
As a result, Churchill Downs or the horse trainer Bob Baffert are not liable to the group’s claims of lost money, according to the federal appeals court
