Nevada Resort Association granted approval to join Kalshi lawsuit

The Nevada Resort Association (NRA) has been granted approval to intervene in KalshiEx LLC’s lawsuit against the Nevada Gaming Control Board (NGCB) and Nevada Gaming Commission by US District Court Judge Andrew Gordon.
Judge Gordon officially signed the order on June 2, enabling the NRA to defend its members’ interests in Kalshi’s lawsuit that was originally brought forward on March 28. The operator began offering prediction contracts on sporting events nationwide during late 2024 before the NGCB issued a cease-and-desist order on March 4.
Kalshi would then respond with the lawsuit, resulting in a temporary injunction preventing gaming regulators from pursuing legal action against the operator eventually being ordered.
“NRA’s members have significantly protectable interests in their Nevada gaming licenses that they have spent substantial sums to obtain, maintain and protect,” Judge Gordon said in his ruling.
“If Kalshi prevails in this case, the NRA members likely would be placed at a considerable competitive disadvantage because Kalshi and others would not have to comply with Nevada’s comprehensive gaming laws, including prohibitions on bettors under 21 and types of bets allowed.”
Kalshi reportedly believes the NRA’s request to intervene was not filed in a timely manner, but Gordon stated the Association’s response was “timely enough” to grant the intervention.
In its motion to intervene, the NRA said it has a “vested interest” in the case due to Nevada’s legal sports betting industry taking $7.8bn in wagers throughout 2024 while the NRA currently represents 70 casino resorts statewide.

The organization went on to predict “seismic” changes in Nevada sports betting if Kalshi and other prediction markets were granted authorization to offer futures contracts on sporting events.
Kalshi argues that it can offer sports prediction contracts because the operator is regulated by the Commodity Futures Trading Commission (CFTC), which provides precedence over state gaming boards nationwide.
Nevada was the first state to issue a cease-and-desist order to Kalshi, with six other states offering legalized sports betting having tried to forbid Kalshi and other markets’ operations since March 4.
North American Derivatives Exchange, operating as Crypto.com, also filed a lawsuit against the NGCB and Nevada Gaming Commission on June 3, naming NGCB Chairman Kirk Hendrick, members George Assad and Chandeni Sendall as well as Attorney General Aaron Ford as defendants.
