California judge calls for arbitration in Boyle vs. Stake.us case

A California federal judge has refused to rule in the pending lawsuit between plaintiff Dennis Boyle and Stake.us, a sweepstakes platform operated by Sweepsteaks Limited.
Instead, US District Court Judge James V. Selna has referred this case to arbitration. Furthermore, the judge decreed that the matter “shall be referred to and finally resolved by arbitration administered by the American Arbitration Association (AAA).”
According to court documents, Boyle claimed the operator “entices players to purchase more gold coins, which are used to play their standard games” which has caused him to lose money during the last three years.
The suit further alleged that Stakes.com operates as an illegal online casino. Boyle initially filed against Stake.us in February.
The Social and Promotional Games Association (SPGA) issued a recent statement regarding the ruling and said it is pleased with the court’s decision.
The SPGA has maintained that Stake.us is “a lawful sweepstakes platform.”
A spokesperson for the SPGA said in a statement, “This ruling affirms what we’ve long said: Social sweepstakes sites are not gambling. They are free-to-play games enjoyed responsibly by millions of American adults, and no purchase is ever necessary to play or have a chance to win prizes.”
“Anyone can file a lawsuit making any claims they like. This ruling is a reminder that facts – and the law – still matter.”
