Nevada Gaming Control Board files motion to dismiss in pending discrimination case

The Nevada Gaming Control Board has filed a motion to dismiss a racial discrimination lawsuit in US District Court in Las Vegas, according to a local report in the Las Vegas Review-Journal.
The suit was brought to court in September by Jamie Black, a former department head of the Control Board.
Black had served on the Control Board since 2014 and held a position as the Administration Division’s head since June 2017. Her suit claims that she was pressured to “engage in discriminatory hiring practices” by Control Board Member Brittnie Watkins and alleges that Watkins “fostered a hostile work environment when she resisted.”
The Civil Right Act protects people from employment discrimination based on their sex, race, color, national origin or religion under Title VII. The law applies to labor organizations, employers, employment agencies and training programs.
The Control Board is represented by the Nevada Attorney General’s office. Its motion to dismiss claims Black’s complaint is “baseless.”
The motion stated, “Despite the redundancy and voluminosity of her assertions, all of Black’s retaliation claims fail to state a plausible claim because the complaint does not adequately allege that she (Control Board Member Brittnie Watkins) engaged in any action that was protected conduct under Title VII (of the Civil Rights Act).
“The board is committed to equal opportunity in hiring and it has never engaged in any hiring practices other than those designed to select the most suitable and qualified candidate. The allegations made by Black in the complaint are baseless.”
The motion also said that Black “fails to allege any facts that could plausibly support a claim for hostile work environment.”
