Colossus Bets today filed suit against the gaming giant DraftKing’s for patent infringement in the United States District Court of the District of Delaware. The suit claims that seven of Colossus’ patents have been infringed upon, covering a diverse range such as sports betting and gaming products that have the Cash Out feature.
This is not the first time the UK-based provider of sports jackpot and gaming technology has leveled accusations of copyright infringement against DraftKings. Colossus first notified them in 2018. Since then, it has provided a number of notices of ongoing infringement.
Colossus is represented in all copyright issues by law firm DLA Piper.
Despite these protestations, DraftKings has continued operating the products in question. Colossus is looking to recover all damages allowed by law, including increased damages that come from DraftKings’ willful, ongoing infringement.
Colossus has a strong range of patents, especially in the realms of sports betting and those games featuring Cash Out.
According to Bernard Marantelli, the Founder of Colossus Bets and the inventor behind the patents in question: “We attempted to resolve this amicably and we gave them ample opportunity to do so.
“We take our intellectual property very seriously. This is the next step towards protecting our rights and income across the industry in the US.”
Colossus Bets was hit especially hard by the economic fallout surrounding the pandemic and may be hoping to retake some of its swagger as the world tries to leave Covid-19 behind. This is not the company’s first legal challenge to supposed copyright infringement, as similar motions have been filed against the Australian operator Tabcorp.
