Brazil: Public Defender’s Office backs betting regulation but calls for advertising limits

Key Points
- The Public Defender’s Office supported Brazil’s Betting Law in a Supreme Court filing
- It requested restrictions on advertising and awareness on healthy gambling
In a Supreme Court hearing, Brazil’s Defensoria Pública da União (DPU), the Public Defender’s Office, voiced its support for the country’s betting regulation law, known nationally as Lei das Bets, while urging for restrictions on advertising and stronger social protections for bettors.
The DPU defended the continuity of legal betting in Brazil, provided that it includes “restrictions, such as limits on advertising and mandatory treatment options for people struggling with addiction.”
It was that mentioned similar models in countries like the UK, Spain and Portugal, where shared responsibility is used to protect vulnerable populations.
The filing also criticised recent proposals by lawmakers to remove welfare benefits, such as Bolsa Família, from individuals who place bets, calling the suggestion punitive and ineffective.
Good to know: A second constitutional challenge, submitted by the country’s Attorney General, claims online betting should be classified as a lottery activity, which in Brazil is reserved for federal operation, and seeks to invalidate the law entirely
Both legal actions are currently stalled in Brazil’s Supreme Court, with no scheduled return.
A recent topic of discussion has been the fact that Brazilian welfare recipients have been spending a significant amount of governmental aid, such as Bolsa Família, on betting platforms.
The DPU’s intervention directly addresses these concerns, calling for a more balanced approach that protects users without penalising those most at risk.
