FanDuel reaches settlement regarding MLBPA lawsuit

Both parties will pay their own attorney fees.
Key Points
- The lawsuit claimed unauthorized use of MLB player names and images were used
- The suit was dismissed without prejudice
FanDuel and a commercial affiliate of the Major League Baseball Players Association (MLBPA) have reached settlement for an ongoing lawsuit, according to an Associated Press report.
The suit was filed because of “alleged unauthorized use of the names and images of MLB players on its sports betting platform.”
FanDuel agreed to “a voluntary dismissal of the lawsuit with prejudice,” according to the settlement.
Under the terms of the settlement agreement, both the association and the sportsbook “shall each bear their own attorneys’ fees and costs incurred in connection with this matter.”
The MLBPA has not offered comment to the Associated Press beyond acknowledging the settlement.
In other legal news, former Jackson Jaguars employee Amit Patel recently sued FanDuel, alleging that FanDuel Sportsbook “exploited his gambling addiction and intentionally ignored its responsible gaming and anti-money laundering protocols.”
Good to know: This means the lawsuit cannot be filed again
Patel is seeking $250m in damages and is currently serving time at Williamsburg federal prison.
The lawsuit claims that Patel was encouraged to keep using the sportsbook through incentives to play fantasy sports “despite Patel exhibiting signs of problem gambling.”
It further alleges that that Brett Krause, Patel’s VIP host at FanDuel “communicated with Patel as many as 100 times a day between 2021 and 2023, on several occasions contacting Patel on days he was not gambling to find out why.”
Matthew Litt, Patel’s attorney said in a written statement, “Defendants actively and intentionally targeted and preyed on Plaintiff with incentives, credits, and gifts to create, nurture, expedite, and/or exacerbate his addiction with the only possible outcome that he would ultimately hit rock bottom.”
