Kickapoo Tribe in Texas looks to pursue casino gambling

After claiming that it does not sell lottery tickets online, the Texas Lottery Commission is facing pushback from the The Kickapoo Traditional Tribe of Texas.
The Tribe sent a letter to the Senate State Affairs Committee highlighting that proliferating courier services are operating against state laws and represent an expansion of gambling in Texas. Kickapoo also called for a prohibition on the courier services’ operations.
The Commission has said in hearings that couriers outside of its jurisdiction sell lottery tickets online, meaning that the couriers are either acting as illegal sales agents, or that sales agents are operating subject to the couriers.
Kickapoo’s letter noted that state law prohibits sales by a person who is not a sales agent or an employee of a sales agent. The Tribe suggested that the lottery is serving as a random number generator to simulate real-time online games of chance, much like slot machines.

Due to these findings, the Kickapoo Tribe has expressed interest in triggering Class III status with the federal government to move beyond the “bingo-type slot machines” currently allowed in Las Vegas-style gambling.
While industry experts in the state did not express optimism that the Texas Legislature would legalize casinos ahead of 2025, the Tribe may move forward without approval from lawmakers unless it believes the lottery is put under stricter control.
