Massachusetts court rules in favor of Wynn Resorts’ Boston casino

The decision allows the continued use of coinless self-serve machines on the casino floor.
An appeal against Wynn Resorts’ Encore Boston Harbor’s use of coinless self-serve machines was overturned, according to a recent Bloomberg Law report.
A Massachusetts class action suit filed by A. Richard Schuster claimed that Encore’s 28 coinless kiosks “departed from Wynn’s internal controls.”
The machines gave out bills for their casino-floor tickets and issued additional redemption tickets for the remaining change. The suit claimed that this practice violated the casino’s internal controls, along with government and industry regulations and stated that the machines should “dispense the appropriate amount of funds.”
The First Circuit panel ruled in favor of Wynn Resorts, the parent company of Encore Boston Harbor and determined that “the use of coinless self-serve machines that don’t pay out the full value of slot machine redemption tickets does not constitute an unfair or deceptive business practice.”
The ruling also determined that self-serve kiosks were not required to give out coins, and players could redeem those coins from a cashier.
Wynn Resorts owns and operates four locations, including Wynn Las Vegas, Encore Boston Harbor, Wynn Palace and Wynn Macau. The group is part of the S&P 500 Index, as well as on the Nasdaq Global Select Market and is traded under the WYNN ticker symbol.
Encore Boston Harbor’s casino expansion project was recently put on hold. Wynn Resorts said that the city of Everett and the casino have not been able to come to an agreement on taxes and impact fees, thus resulting in the project’s suspension.
The first phase of expansion involves building a new facility across from the $2.6bn casino. Wynn Resorts said it plans to add a poker room second sports betting parlor, a theater, nightclub, comedy club and parking garage.
