Como presidente interino, Avery tiene la misma autoridad legal para dirigir el NIGC y tomar medidas oficiales que tendría una persona nombrada por el Senado. Su nombramiento entró en vigor el 15 de mayo.

El NIGC continúa regulando y apoyando la integridad del juego indio. Junto con las tribus y los estados, el NIGC regula actualmente más de 500 establecimientos de juego operados por casi 250 tribus en 29 estados.
